How to Apply for a Marriage License

Marriage is a huge milestone for couples. A lot of time and money is spent planning a wedding, and for everything to go as planned. Yet while a wedding makes for a very exciting day, there are several legal matters that need to be taken care of as well.

In order for a wedding to go as planned—with no major issues—each spouse needs to understand the process of becoming legally married.

Process of Obtaining a Marriage License

In DuPage County, a marriage license is immediately issued to the applicants and becomes effective after 24 hours. Each spouse must appear at the DuPage County Clerk’s Office and provide the following:

  • Proof of age;
  • Proper identification; and
  • $35 license fee.

Examples of adequate proof of age and proper identification requirements include a valid driver’s license, a valid U.S. passport, a valid U.S. military identification card, a birth certificate, a valid U.S. resident alien card, a valid foreign passport, or a life insurance policy that has been in effect for one year.

The $35 fee can be paid in cash or check with no additional fee. If the applicants would like to pay with a credit card, then a $1 processing fee will be applied.

Who Can Apply for a Marriage License?

Anyone who is older than 18 years of age can marry without parental consent. Neither spouse can be directly related. However, first cousins older than 50 years of age are allowed to marry.

Anyone who is 18 years old can marry after showing proof of identification through a valid birth certificate.

If the applicants applying for a marriage license are younger than 18 years of age, then each parent must swear consent in person before the County Clerk at the time of application, as well as provide proper identification.

Each applicant must also provide a copy of a birth certificate and second piece of identity that shows date of birth.

For any applicant who has been previously married, he or she must provide information on how the previous marriage ended, including date, county, and state.
